CRATETerms of Service

The short version: Crate Blitz is a free game. Play fair, be decent to other players, and don't try to break or abuse the service. Coins, crates and skins are just for fun: they can't be bought or sold and have no real-world value. We can ban accounts that break these rules.
These Terms of Service ("Terms") are an agreement between you and kaosu, LLP ("we", "us") about your use of Crate Blitz, including the website at crateblitz.com, the touch version at crateblitz.com/app, and the game servers behind them (together, the "Service"). By playing or creating an account, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
1. Who can play
You must be at least 13 years old to use the Service. If you are under 18, or under the age of majority where you live, you may only use the Service with the permission of a parent or legal guardian, who agrees to these Terms on your behalf.
2. Accounts
- You can play as a guest, or create an account with an email address and password, or with Google or Discord sign-in.
- You're responsible for keeping your login details safe and for everything done with your account. Tell us right away if you think someone else has accessed it. We strongly recommend turning on two-factor authentication.
- Your username must not impersonate anyone, including staff, and must not be offensive, hateful, sexual or misleading. We may change or remove usernames that break this rule.
- One person may not use accounts to get around a ban.
3. Coins, crates, skins and other virtual items
- The Service includes virtual items such as coins, experience points, levels, crates, weapon skins, characters, accessories and upgrades ("Virtual Items"). Virtual Items are earned by playing. They cannot be purchased with real money, and they can't be sold, traded or transferred, or exchanged for money or anything of value.
- Virtual Items are not your property. We grant you a limited, revocable, non-transferable licence to use them inside the Service only.
- Crates give random items with the odds shown in the game. We may change items, prices, odds, rewards and game balance at any time.
- Virtual Items may be removed if they were obtained through cheating, bugs or exploits, if your account is banned or closed, or if the Service ends. You won't be compensated for lost Virtual Items.
- Guest progress is not saved.
4. Rules of conduct
When using the Service you must not:
- cheat: use aimbots, wallhacks, speed hacks, macros, modified clients or any other software that gives an unfair advantage;
- exploit bugs. If you find one, please report it to us instead;
- harass, threaten, bully or abuse other players, or post hateful, sexual, violent or illegal content in chat or usernames;
- share other people's personal information;
- spam, advertise, or send phishing or malicious links;
- attack, overload, scrape, reverse engineer or interfere with the Service or its servers, or try to access accounts or data that aren't yours;
- use the Service in any way that breaks the law.
5. Moderation
Our moderators ("admins") may warn, mute, kick or ban any player or account, temporarily or permanently, and may block the network addresses used to break these Terms. We may do this at our discretion when we believe these Terms have been broken or the Service or its players need protecting. We'll usually tell you the reason in the game. If you think a ban is a mistake, contact us at support@crateblitz.com.
6. Your content
You are responsible for what you write in chat and choose as your username. You give us permission to display, store and moderate that content as needed to run the Service. Chat is not private and is visible to other players in your match.
7. Our content
The Service and everything in it, including the game, code, artwork, maps, models, sounds, names and logos, belongs to kaosu, LLP or its licensors and is protected by law. You may play the Service for personal, non-commercial purposes. You may stream or record your gameplay and share it, including on monetized channels, as long as you don't suggest that we endorse you.
8. Third-party services
If you sign in with Google or Discord, your use of those services is governed by their own terms. We are not responsible for third-party websites or services linked from the Service.
9. Availability and changes
The Service is provided for free and may change, be interrupted for maintenance, or be discontinued at any time, with or without notice. We may update or reset game features, progress systems and balance. We don't guarantee that the Service will always be available, error-free or secure.
10. Ending your use
You can stop using the Service at any time and ask us to delete your account. To do so, email support@crateblitz.com from the address on your account. We may suspend or close your account if you break these Terms or if we stop offering the Service. Sections 3, 7 and 11 to 14 continue to apply after your access ends.
11. Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, KAOSU, LLP AND ITS PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROGRESS OR VIRTUAL ITEMS, ARISING FROM YOUR USE OF THE SERVICE. BECAUSE THE SERVICE IS FREE, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO US$50. Some places don't allow these limits, so they may not fully apply to you.
13. Indemnity
You agree to cover any claims, losses or costs, including reasonable legal fees, that arise from your breaking these Terms or the law while using the Service.
14. General
- These Terms are governed by the laws of the United States and of the state in which kaosu, LLP is organized, without regard to conflict-of-law rules. Any dispute will be handled in the courts located there, unless the law where you live requires otherwise.
- If any part of these Terms can't be enforced, the rest stays in effect. If we don't enforce a rule straight away, that doesn't mean we give up the right to enforce it later.
- These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we'll change the effective date above, and for significant changes we'll give notice in the game or on the website. If you keep using the Service after the changes take effect, you accept the new Terms.
